Discover Helsinki App – General Terms and Conditions

These terms and conditions (“Terms”) govern your access and use of the Discover Helsinki app online service (“Service”). By accessing and using the Service you agree that you have read and accepted these Terms and that they shall apply to your use. If you do not wish to be bound by these Terms please leave the Service.

The Service is operated and maintained by Naisten Kaupunki Markkinointi ja Kustannus Oy, a Finnish company with the business ID 1038092-4. The Service consists of content mainly developed by Naisten Kaupunki Markkinointi ja Kustannus but it may also include third party generated content or components.

Naisten Kaupunki Markkinointi ja Kustannus aims to maintain the Service in a way which allows its use 24 hours a day. Naisten Kaupunki Markkinointi ja Kustannus reserves the right to take the Service or part thereof temporarily out of use for maintenance, equipment installation, excessive online traffic or for any other reason. Naisten Kaupunki Markkinointi ja Kustannus does not give any direct or indirect guarantee of the operation, availability or suitability of the Service for any particular purpose. Naisten Kaupunki Markkinointi ja Kustannus does not guarantee that the Service operates without interruptions or faults at all times. Naisten Kaupunki Markkinointi ja Kustannus reserves the right to terminate the provision of the Service in whole or in part at any time. Unless required by applicable law, the Service is provided as it is and Naisten Kaupunki Markkinointi ja Kustannus shall not be responsible for any direct or indirect damage caused to you or any third parties arising from the use of the Service. You are responsible for ensuring that the equipment and software you use does not cause damage, disruption or damage to APP or to other users of the Service.

In accordance to Chapter 6, Clause 16, Point 1 of the Consumer Protection Act of Finland (“Kuluttajansuojalaki/Konsumentskyddslagen”), you acknowledge that once you have accessed the fee-based parts of the Service and once the delivery of the Service has been electronically initiated by Naisten Kaupunki Markkinointi ja Kustannus, you do not have the right to cancel the Service in the way mentioned in Chapter 6 Paragraph 15 of the Consumer Protection Act of Finland (“Kuluttajansuojalaki/Konsumentskyddslagen”).

Naisten Kaupunki Markkinointi ja Kustannus reserves the right to change these Terms at any time without notice. Naisten Kaupunki Markkinointi ja Kustannus endeavours known to any third party to inform changes to the Terms through the Service or in some other way within a reasonable time before the changes come into force. Naisten Kaupunki Markkinointi ja Kustannus has the right not to publish or delete content from the Service, which in sole discretion is considered to be unlawful or contrary to good practice or moral, or can be deemed to be harmful or detrimental.

You acknowledge and agree that it is your responsibility to keep secure and confidential the username and password that Naisten Kaupunki Markkinointi ja Kustannus gives you, and not to disclose or otherwise provide such username or password to any third party, or to let such become public knowledge. You agree to advice Naisten Kaupunki Markkinointi ja Kustannus immediately if you become aware, or have reasonable cause to believe, that the username and/or password has become compromised.

You acknowledge that Naisten Kaupunki Markkinointi ja Kustannus may suspend and/or terminate (either in whole or in part) your use of any username if you violate these Terms for any reason.

Ownership of Service and Copyrights

Ownership, copyright, trademark and all other intellectual property rights in the Service are owned by Naisten Kaupunki Markkinointi ja Kustannus or its designated third parties. The Service and its content, are protected by copyright law (“Tekijänoikeuslaki/Upphovsrättslagen”) and international treaties. No other rights than a license to use the Service as set out in these Terms are granted you.

You hereby agree to grant Naisten Kaupunki Markkinointi ja Kustannus an unrestricted, worldwide, sub-licensable, royalty-free and irrevocable license to use, including the right to produce content, pieces and publications, the right to modify content, pieces and publications and the right to pass the user rights to third parties, to all content you have uploaded to the Service. When uploading material to the Service you warrant that you have the right to upload the material to the Service, and the right to grant Naisten Kaupunki Markkinointi ja Kustannus the above-mentioned license.

Third Party Content

The Service includes content developed and operated by third parties. Third party components of the Service are governed by their own terms, conditions and privacy policies.

Naisten Kaupunki Markkinointi ja Kustannus processes Service users’ personal information according to its own business processes and in accordance to the applicable laws. Service users’ personal data is processed by Naisten Kaupunki Markkinointi ja Kustannus as required by the Personal Data Act (“Henkilötietolaki/Personuppgiftslagen”) can be viewed here.

You agree and acknowledge that your personal data may be used by Naisten Kaupunki Markkinointi ja Kustannus and other companies belonging to the same group of companies as Naisten Kaupunki Markkinointi ja Kustannus to provide the Service, to maintain customer relationships, for billing, for distance sales, for preparation of studies of use, for further development of the Service, for direct marketing and for opinion polls and market research.

Naisten Kaupunki Markkinointi ja Kustannus stores log data on its servers and may also use third party logging services to collect data. All personal data shall be destroyed in accordance with the applicable data protection laws, and the data is thereafter analyzed. This data is used by Naisten Kaupunki Markkinointi ja Kustannus to gather anonymous information from Service users and further develop the Service. During visits to the Service following user-specific data is collected: (i) operation system, (ii) browser, (iii) IP address, (iv) country and territory, (v) time and date of visit.

Naisten Kaupunki Markkinointi ja Kustannus is using Facebook ID Kit to collect information about the use of it’s mobile app(s) and website(s) such as Discover Helsinki.

Naisten Kaupunki Markkinointi ja Kustannus is using Google Analytics to collect information about the use of Discover Helsinki web app.

Google Analytics is a web analysis service provided by Google. Google utilizes the data collected to track and examine the use of www.discoverhelsinki.fi, to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network.

In order to monitor the Service, Naisten Kaupunki Markkinointi ja Kustannus is using Facebook ID Kit to collect information about the use of its mobile app(s) and website(s).

Naisten Kaupunki Markkinointi ja Kustannus is using Google Analytics to collect information about the use of Discover Helsinki web app. Naisten Kaupunki Markkinointi ja Kustannus shall occasionally transfer Cookies to the Service users’ computers. A Cookie is a small text file which is used to gather data on how and when a web service is used. Cookies do not damage users’ computers or files.

The data is used to develop the Service further to better serve the users. In addition, the data is used by Naisten Kaupunki Markkinointi ja Kustannus and its partners to monitor the number of visitors to the Service. Naisten Kaupunki Markkinointi ja Kustannus and its partners may use the data gathered using Cookies for marketing and advertising purposes. The data gathered using Cookies shall not be used to identify individual users.

A user can prevent the use of Cookies by changing his browser options. Blocking Cookies may have an effect on the functionality of the Service or parts of it.

Other

Naisten Kaupunki Markkinointi ja Kustannus has the right to transfer the Service and its maintenance, and related personal registries to a company which has acquired its business or the control of its business.

These Terms are governed by and constituted in accordance with the laws of Finland. Any disputes concerning the Service shall be settled by Helsinki District Court.”
